THE TERMS AND CONDITIONS SET FORTH BELOW ARE THE TERMS AND CONDITIONS OF THE RON SMITH & ASSOCIATES, INC. WEB SITE WITH RESPECT TO THE USE OF THE RON SMITH & ASSOCIATES, INC. FORENSIC JOB PLACEMENT SERVICE. THE RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE IS OPERATED SEPARATELY FROM ALL OTHER RON SMITH & ASSOCIATES, INC. SERVICES AND HAS DIFFERENT INFORMATION COLLECTION AND USE PRACTICES. YOUR USE OF THE RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE IS CONDITIONED UPON YOUR AGREEMENT TO BE BOUND BY THE RON SMITH & ASSOCIATES, INC. TERMS AND CONDITIONS.
You should read the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE Terms and Conditions (the "Terms and Conditions") carefully. By using the site, you affirmatively agree to abide by the Terms and Conditions with respect to the RON SMITH & ASSOCIATES, INC. FORENSIC JOB PLACEMENT SERVICE (the "RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE"). As used below, the terms "You" and "User" mean any RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE member who activates a personal user account on the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE SITE.
Any capitalized terms used but not defined herein have the meanings ascribed to them in the Terms and Conditions.
1. Privacy
A. Types of Information Collected
In connection with your use of the RON SMITH & ASSOCIATES, INC. Job Placement Service Site, we ask for, and may collect, information from and about you in various ways and at different points on the service. Some of the information that you submit may be personally identifiable information (that is, information that can be uniquely identified with you). To begin using the RON SMITH & ASSOCIATES, INC. Job Placement Service Site, you will be asked to register by opening a personal user account. Through the Employee Candidate Profile Form certain information, including Educational Experience, Professional Licenses, Professional Affiliations, Professional Certifications, and Employment History is collected. Additional information, such as, job type, salary range and desired location of employment ("Employment Preferences") is also collected. An asterisk indicates which information on the profile form is mandatory in order to complete the registration process. Your Subscriber Information, Registration Information and Candidacy Information are collectively referred to below as your "Employee Candidate Profile."
B. Use of Information
By the Employee Candidate
Once you have activated your RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE personal user account, RON SMITH & ASSOCIATES, INC. submits your Employee Candidate Profile Information to the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE search engine to attempt to match your information with available job postings. Upon a match of your Employee Candidate Profile Information with a job posting, the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE will notify you via email of the results of the search. Based on the “Information Dissemination” level you personally select on the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE SITE, your contact information and a employee candidate profile will / will not be shared with perspective employer subscribers.
By the Potential EmployerSubscribers
RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE has granted potential employer subscribers the right to post job openings and run searches through the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE search engine to match their job postings with Employee Candidates Profile Information. If you authorize RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE to share your Employee Candidate Profile Information with a potential employer subscriber, the potential employer subscriber has agreed to treat that information as confidential and to not disclose it to any third party without your prior written consent.
Third Parties
RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE has contracted with Cybird, Inc, a third party software / web design company, to implement and host the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE SITE. Information collected from you and potential employers will be stored on Cybird server and processed through its search engine. [Cybird, Inc. is not permitted to disclose your personally identifiable information to any third party.]
C. Disclosure of Information
Your Employee Candidate Profile Information is released only when you choose to do so, and your information is only released to the potential employer subscriber who posted the job to which you are responding. Once your Employee Candidate Profile Information has been forwarded to a potential employer subscriber, all correspondences are directly between you and that potential employer subscriber. Employer subscribers have agreed to not disclose your Employee Candidate Profile Information to third parties.
As a user of the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE, you may restrict distribution of your Employee Candidate Profile Information by indicating such restrictions in your account. RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE will not send unsolicited promotional messages (as opposed to administrative messages) to users of the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE SITE who indicate that they do not wish to receive such messages.
As indicated above, you will be informed at each collection point what information is required and what information is optional. If the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE matches your Employee Candidate Profile Information with a particular job posting, you will be notified by email.
D. Access
You can access your Employee Candidate Profile Information by logging into your account by using your name and password at RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE SITE. Once there, you can modify select parts of your Employee Candidate Profile Information to account for additional degrees, certifications, licenses, etc.
E. Ownership and Use of Content
RON SMITH & ASSOCIATES, INC. or its licensors own exclusively all content on this JOB PLACEMENT SERVICE SITE including, but not limited to, graphics, logos, text, data, downloadable software, page layout and look and feel of the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE web pages (the "Content"). The Content is protected under U.S. and international copyright laws. Except for the license granted herein, your use of the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE gives you no rights in RON SMITH & ASSOCIATES, INC or its licensors copyrights, trademarks, trade secrets or any other intellectual property rights.
RON SMITH & ASSOCIATES, INC. grants to you a personal, non-transferable and non-exclusive right to access and use the Content solely for your own personal use in connection with your search for a job for yourself or for career information and in accordance with the Terms and Conditions and these Supplemental Terms and Conditions. No portion of the Content may be, disclosed to, or modified, copied, sold, leased, distributed, transmitted or used for any commercial purpose or on behalf of any other person or entity.
You agree not to incorporate the Content into another database, search engine or networked computer environment of any kind. You may not access the Content by means of any automated processes, spiders, bots or similar devices or interfere or attempt to interfere with the proper operation of the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE. You agree not to modify, copy, transmit, create derivative works from, reverse engineer, disassemble, or otherwise attempt to discover any source code from, any software accessible or available through the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE, or sell, assign, sub-license or otherwise transfer any right in such software.
RON SMITH & ASSOCIATES, INC. will terminate the accounts of any users, and block access to the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE of any users, who are infringers of the copyrights, or other intellectual property rights, of RON SMITH & ASSOCIATES, INC. and others. RON SMITH & ASSOCIATES, INC. reserves the right to take these actions at any time, in its sole discretions, with or without notice, and without any liability to the user whose account is terminated or to the user whose access is denied.
2. Use of the Job Placement Service
In consideration of your use of the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE, you agree to use the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE only to locate job opportunities and obtain career information as described above. You agree not to (a) use the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE for any fraudulent, illegal, harassing or offensive activity including, but not limited to, the submission of sexually explicit material or content inappropriate for viewing by minors, or which is likely to offend or criticize any employer, employee, group or portion of society, and (b) provide any information where such provision constitutes the infringement or violation of any right of any third party. You agree not to engage in any activity that would impair the proper functioning of the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE and its Content. Specifically, you agree not to provide any false or misleading information or engage in any activity to defeat any security or feature of the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE. You agree not to post any incomplete, false or misleading biographical information or information that is not about you (and you represent that you are a living individual seeking employment on a full-time or part-time basis on his or her own behalf). You agree to not delete or revise any Content posted by any other person or entity. If you take any of the prohibited actions described above, or if RON SMITH & ASSOCIATES, INC. has reasonable grounds to suspect that you have taken any of the prohibited actions described above, RON SMITH & ASSOCIATES, INC. may suspend or terminate your account and refuse any and all current and future use of the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE.
3. Only a Venue; Disclaimers
The RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE is only a venue. The RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE acts as a venue for RS&A employers to post job opportunities and candidates to post Employee Candidate Profiles and does not screen or censor the listings offered. RON SMITH & ASSOCIATES, INC. is not involved in the actual transaction between employers and candidates. As a result, neither RON SMITH & ASSOCIATES, INC. nor its agents have control over the quality, safety or legality of the jobs or profiles posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings. In addition, note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretenses. You assume all risks associated with dealing with other users whom you come in contact through the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE.
RON SMITH & ASSOCIATES, INC. does not review or confirm the accuracy of any Content, personally identifiable information or job postings on the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE SITE, but reserves the right to review and reject any information it believes to be contrary to the Terms and Conditions or these Supplemental Terms and Conditions. RON SMITH & ASSOCIATES, INC. reserves the right to remove any Content, personally identifiable information or job postings, deactivate any account, or otherwise terminate access to the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE for violation of any of the Terms and Conditions or these Supplemental Terms and Conditions, or if otherwise compelled by court order. RON SMITH & ASSOCIATES, INC. does not endorse or sponsor in any way the activities, products, services or policies of any person or company which posts information on, or which serves as part of, the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE. RON SMITH & ASSOCIATES, INC. accepts no responsibility for the accuracy or completeness of any Content posted, or the hiring practices or policies of potential employers.
4. Trademarks
RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE is a trademark or service mark of RON SMITH & ASSOCIATES, INC. and CYBIRD is a trademark or service mark of CYBIRD Inc. RON SMITH & ASSOCIATES, INC. and CYBIRD, INC. do not grant to you any rights under the Terms and Conditions with respect to these trademarks or any other trademarks of either RON SMITH & ASSOCIATES, INC. or CYBIRD, INC.
5. Indemnification
You agree to promptly indemnify RON SMITH & ASSOCIATES, INC. and its officers, directors, employees, members, agents and affiliates ("Associates") for all damages, liabilities, costs, charges and expenses, including reasonable legal and accounting fees ("Costs"), that RON SMITH & ASSOCIATES, INC. or its Associates incur as a result of your breach of the Terms and Conditions, these Supplemental Terms and Conditions or any Costs relating to the Content or in any way relating to your conduct with any other user of the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE. RON SMITH & ASSOCIATES, INC. shall provide to you timely notice of any claim, suit or proceeding which could give rise to an indemnification obligation hereunder.
6. Disclaimers
IN ADDITION TO THE OTHER PROVISIONS OF THE TERMS AND CONDITIONS FOR THE SITE, ALL DISCLAIMERS BY RON SMITH & ASSOCIATES, INC. SET FORTH IN THE TERMS AND CONDITIONS APPLY TO YOUR USE OF THE RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE.
7. Termination
These Supplemental Terms and Conditions are effective until terminated by either RON SMITH & ASSOCIATES, INC. or you. If you no longer agree to be bound by these Supplemental Terms and Conditions, you must cease your use of the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE. Subject to applicable law, RON SMITH & ASSOCIATES, INC. reserves the right to suspend or deny, in its sole discretion, your access to all or any portion of the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE with or without notice. You agree that any termination of your access to the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE may be effected without prior notice, and acknowledge and agree that RON SMITH & ASSOCIATES, INC. may immediately deactivate or delete your account and all related information and files in your account and bar any further access to such files or the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE. Further, you agree that RON SMITH & ASSOCIATES, INC. shall not be liable to you or any third party for any termination of your access to the RON SMITH & ASSOCIATES, INC. JOB PLACEMENT SERVICE.
